OPA denies appeal over medical referral services contract

Guam - A medical referral services contract award that was protested by APM: Guam Medical Referral Services and Peter Alexcis Ada has been upheld by the Office of Public Accountability.  Ada filed a protest after the contract was awarded to Tom Fisher and Associates alleging his sealed bid had been opened and protesting the General Services Agency's finding that his technical offer was unacceptable. 

After reviewing the facts of the case, the OPA found that GSA correctly found APM's bid unacceptable and that the opening of APM's sealed bid was an "inadvertent mistake" that had no effect on the procurement process.  According to the decision, "there is no evidence that APM's bid cost was tampered with." 

Additionally the public auditor found that APM could provide no evidence of a violation of Guam Procurement Law and Regulations.  Ada and APM has 14 days to appeal the decision to the Superior Court.
