Guam - The Government of Guam believes a class action lawsuit seeking the payment of tax refunds is moot. Jeffrey and Rea Paeste and Sharon and Glenn Zapanta filed the suit originally seeking the payment of overdue tax refunds. The complaint was later amended claiming government officials violated their 14th Amendment right to equal protection of the law by prioritizing payments to some on an expedited basis.
It's that policy the plaintiffs are attacking. The government contends the suit is moot because the plaintiffs have been paid their tax refunds and the government will be selling a second series of bonds to pay 2011 tax refunds in the summer of next year.
