Judge Consuelo Marshall assigned to refund suit

Guam - It's unclear whether next month's payment of tax refunds will resolve a civil suit filed by Jeffrey and Rea Paeste and Sharon Zapanta. The suit asks the court to order the government to develop a standard and fair procedure to pay out tax refunds on a regular basis.
California District Court Judge Consuelo Marshall has been assigned the case after Chief Judge Frances Tydingco Gatewood recused herself from the matter because her son is owed a refund. The Government of Guam has moved to dismiss the suit as they contend the case is not ripe to be heard and they contend that the class cannot be certified because taxpayers are owed different refund amounts.
