DepCor moves to dismiss federal detainee's lawsuit
by Mindy Aguon
Guam - The Department of Corrections has moved to dismiss a lawsuit that was filed by federal detainee Jason Daniels because it wasn't properly served a copy of the complaint. In a motion to dismiss filed in the District Court, the Attorney General's Office asks the court to throw out the lawsuit.
The government argues Daniels seeks an improper remedy by asking for damages of $50,000, failed to make class action allegations and not properly served DepCor. Daniels alleges substandard conditions in the Post 30 unit and claims DepCor isn't keeping up with standards imposed by the federal Bureau of Prisons.
