Judge takes dismissal motion under advisement

A motion to dismiss filed by former police chief Captain Paul Suba and two police officers accused of violating a local businessman's civil rights has been taken under advisement.

Guam - A motion to dismiss filed by former police chief Captain Paul Suba and two police officers accused of violating a local businessman's civil rights has been taken under advisement. Arguments were presented today to District Court Chief Judge Frances Tydingco Gatewood.  Suba and Officers Serafino Artui and D.B. Anciano have moved to dismiss the suit, contending they are government officials that have qualified immunity protecting them from civil damages liability. 

Adkins filed suit alleging he was wrongfully arrested, detained and incarcerated for taking photographs of a car accident with his cell phone. 

He is seeking $3,000,000 in damages.
