Supreme Court reverses judgments against Gutierrez, Lujan

The Supreme Court has found former governor Carl Gutierrez and former hospital administrator Dr. Davina Lujan should not be held personally liable for violations of the Enforcement of Proper Government Spending Act.

Guam - The Supreme Court has found former governor Carl Gutierrez and former hospital administrator Dr. Davina Lujan should not be held personally liable for violations of the Enforcement of Proper Government Spending Act. The trial court had issued a $100,000 judgment against Lujan and a $300,000 judgment against Gutierrez finding they violated their fiduciary duties when they allowed the hospital to enter into a settlement agreement with Dr. Vivien Batoyan Sagisi.

Justices reversed the lower court's findings and determined it was reasonable for the two to believe the agreement was valid because it was approved by the acting attorney general at the time.
