Younex to appeal intervention denial

Concerned about the negative impact the case is having with the Emerald Oceanview Condominium project, Younex International intends to file appeal a judge's decision denying the company's motion to intervene.

Guam - Concerned about the negative impact the case is having with the Emerald Oceanview Condominium project, Younex International intends to file appeal a judge's decision denying the company's motion to intervene. Judge Elizabeth Barrett-Anderson denied the intervention, saying the request was untimely since the case was filed several years ago.   

Mary Ann Sablan won her case against the Guam Land Use Commission after not receiving notice of Younex's zone variance application. Younex senior vice president David Tydingco says the company, through its attorneys, will take appropriate legal action to appeal the decision to assure that any final outcome will not negatively impact the project.

In the meantime, Sablan's attorney, Darlene Hiton, was pleased with the judge's latest ruling, saying the case is a simply example of the government failing to follow the law.  Hiton added that her client is relieved that the court would not tolerate blatant disregard for established rules and regulations.
