Hearing for case against GEC set for June

Guam - A scheduling conference was held today for the complaint filed by Carlo Branch against the Guam Election Commission. Branch alleges the GEC violated the Open Government Law by failing to give adequate notice of their board meetings as well as failed to follow requirements of the Americans with Disabilities Act.
Attorney Gary Gumataotao, who represents, Branch says the parties will likely just brief the court rather than go to trial. "If the decisions of this commission are in fact voided, then everything's up in the air as to what they decided, and there is a remedy for that if it is voided then the normal remedy would be a ratification of what had happened so that's still possible. This may not have the kind of impact that some people think it would have then again it may have a far-reaching impact," he explained.
The hearing will continue on June 29 at 3:30pm before Judge Elizabeth Barrett Anderson.
