Attorneys want all retirement charges dropped

Guam - While efforts are still underway to select a jury, defense attorneys for former governor Carl Gutierrez and former Government of Guam Retirement Fund director John Rios are asking the judge to reconsider. A motion for reconsideration was filed by Rios' attorney, Mike Phillips, who argues that the court should have dismissed all of the criminal charges, not just half of them.
According to the motion, the defense believes the court erred by failing to throw out the remaining conspiracy charges. Phillips argues the judge's decision to throw out conspiracy charges mandates the dismissal of the remaining official misconduct charges.
The court meanwhile will continue jury selection this week as they prepare the case for trial.
