Guam - Superior Court Judge Vern Perez has yet to rule on motions for acquittal and dismissal filed by the defense in a criminal case still pending against four police officers. Joseph Duenas, Joaquin Castro, Reynald Alcantara and James Quenga have not had their case cleared even after a jury acquitted them on all charges, but a single assault charge as a lesser offense.
The jury could not reach a verdict on that charge and as such the defense has asked the judge to throw out the charge. Defense attorneys today argued that there was no specific instruction to the jury on making a decision for lesser offenses that what the officers were originally charged with.
The court said he would issue a decision soon.
