Major General Benny Paulino says that a recent move by fire chief David Peredo is in direct violation of the Uniformed Services Employment and Re-employment Rights Act.

Last month Peredo issued a memo saying he would no longer grant leave share for all deployed personnel, instead he would decide on a case by case basis.  The decision was prompted by the high number of firemen going on voluntary leave, leaving the department severely understaffed.

In a letter to senator Frank Aguon Jr, Paulino said "it would be discriminatory and violation of userra law if an employer denies a service member employee a benefit of their employment because of their military commitment".

The fire chief has since rescinded that order.
