A man accused of killing a woman and her 1-year-old daughter in a deadly Dededo crash will remain behind bars on $5,000 cash bail.

23-year-old John Mariano Moses appeared Tuesday afternoon in the Superior Court of Guam, hours after being formally charged by the Attorney General’s Office.

Prosecutors charged Moses with two counts of vehicular homicide as second-degree felonies and vehicular negligence with injuries, stemming from a Sunday morning collision involving a white Honda and a red Nissan that killed 30-year-old Charity Mina Berry and her daughter Minareen Immy.

After finding probable cause, the magistrate heard arguments on bail. Prosecutors sought cash bail, citing Moses’ prior driving-while-impaired conviction and the potential 25-year sentence he faces if convicted.

The defense argued for release on a personal recognizance bond, pointing to alleged weaknesses in the case and noting Moses later surrendered to police.

Ultimately, the judge ordered Moses held on $5,000 cash bail, citing the two deaths and Moses’ prior vehicle-related conviction.
