Southern High elevator woes back before federal court

Still no working elevator for a student with a mobility disability, and others at southern high school on the first day of school, that’s the claim back before the District Court of Guam.
The student’s attorney, Daniel Somerfleck, Executive Director of Guam Legal Services Corporation-Disability Law Center, filed a motion asking the court to reconsider its July denial.
Court documents show the earlier decision was based on evidence from GDOE Superintendent Dr. Kenneth Swanson, that the elevator in Southern High’s Building 1000 had been repaired and was operable, with a conditional permit to operate from the Department of Public Works.
That permit was valid until Sept. 30 or until a licensed inspector completed a sign-off.
But according to the new filings, that permit was revoked on Aug. 8, just day two into the new school year.
Court documents also alleged the permit was only intended for those working on the elevator, not for public use, and students could only use it after a QEI safety inspection.
On Aug. 11, that inspection was completed, resulting in no recommendation for continued passenger use. The inspector flagged 60 deficiencies with the elevator.
