It was the Guam Medical Association (GMA), on behalf of American Medical Clinic physicians Dr. Hoa Nguyen and Vincent Akimoto, who sought the Attorney General's intervention.

AG Moylan said their concerns ranged from potentially toxic mold to a lack of critical medicines and supplies.

“We are here on behalf of the people of Guam, so we committed to the doctors that we are going to assess the information they're giving us and send a letter over to the hospital's administrator as well as to the Governor who has Organic Act authority to oversee health care on Guam to see their response and see if there's actually a dangerous condition,” Moylan said.

Moylan added it was he who floated the idea of a federal receivership, bringing in mainland expertise and federal dollars to address what the doctors see as life-threatening conditions.

Moylan said, “We're in a situation that whether you're talking mental health, the prison, Guam has gone into federal receiverships when our government cannot provide the services. We need to get off our high horse and start looking at if we can't provide the services, and especially health care in a proper and timely fashion, then give it to somebody that can.”

But both Moylan and the doctor's biggest complaint is a lack of transparency.

“That's what got me, they don't release the environmental report and they dont inform the public that they don't have certain life critical drugs. That they should tell the public we can't provide these types of services, you need to go toGRMC. Why aren't they doing it, is it pride, or what. And all I can see is that they're trying to protect their end and not show that they have a potential complete failure to provide critical health services at GMH, he said. 

The Governor's Office issued a response saying “GMH provides safe, competent care, and remains certified by the centers for medicaid and medicare services.”

They acknowledge GMH’s problems are well known and have not changed in the last three administrations.

The statement goes on, “The only thing that has is the party and gender of the Governor required to fix them....This isn’t about GMH, the statement says, it’s about who they want to blame for it.”
