Investigator recalls bloody crime scene, prosecution's key witness a no show

It’s the second day of trial against murder defendant Branty Walliby. 

An investigator takes the witness stand, recalling the bloody evidence from the scene. 

But the prosecution’s key witness was nowhere to be found. 

Witness testimony takes the jury back to the crime scene.

Prosecutor Sean Brown: Do you or police have any idea what that red stuff is on the vehicle?

Detective Eric Mondia: Yes, we suspect it to be blood, serological fluids seeping from some type of wound. 

That’s what the prosecution’s first witness recalls of the gruesome crime scene during day 2 of the murder trial against defendant Branty Walliby. 

Guam Police Department Detective Eric Mondia interrogated Walliby at the time of his arrest. 

 Walliby stands accused in the beating of Dededo father Arno Narruhn. 

The deadly attack unfolded near the new Fatima Mart in Dededo around this time last year. 

Mondia said, “He did immediately say that made him angry and that he wanted to hurt them. And he struck Arno the first time once. He made a gesture as him falling to the ground. Then he continued to say ‘I punch, I punch, I keep punching.’”

In Judge Alberto Tolentino's courtroom Tuesday, Prosecuting Attorney Sean Brown submitted surveillance footage showing Walliby repeatedly kicking a car in front of the Dededo store within a handful of minutes from the attack.

Mondia testified that crime scene photos captured the hood of that car and the t-shirt Walliby was seen wearing was covered in blood.

“We located Branty and Jerron Walliby. When we made the approach they were very cooperative. They knew why we were there. I requested any clothing they were wearing of the incident,” Mondia said. 

On Monday, Walliby’s brother and co-defendant Jerron, who took part in the alleged attack took the prosecution’s plea deal, admitting to aggravated assault. 

Jerron Walliby was released from DOC yesterday after admitting guilt and was expected to testify against his brother today but was a no show. 

Jerron is the prosecution's key witness and there is no word yet if authorities were able to track him down. 

After failed attempts to locate him, trial recessed by midday but it was said in court both parties want Jerron Walliby to testify. 

Defense settled to allow prosecution to play a recording of Jerron’s change of plea hearing for the jury. 

Trial is ongoing in the Superior Court. 

No word yet if Branty will also be called to testify.
