Murder defendant Nicholas Wayne Moore out on house arrest

After several failed attempts to get out of jail, Nicolas Wayne Moore finally got what he's been asking a Superior Court judge for -- his freedom. 

"It feels great," he told KUAM News. 

When asked if he felt confident about going back to trial, he said, "You can speak to my lawyer about these things. But yeah, we're very competent."

Moore, who is now on house arrest, appeared before Judge Alberto Tolentino today. 

The court granted his release on June 6. 

Moore is currently awaiting yet another trial in connection to an October 2020 drive-by shooting in Agana Heights that sent one man to the hospital.   

He has yet to have his day in court in a separate case for the alleged killing of Michael Castro.

That trial is anticipated to start on Aug. 16. 

As we reported, Moore was detained for almost a year after disobeying a court order. 

Defense attorney Mike Phillips says his client has learned his lesson. 

"He's been totally cleaned since, since he's been released," he said. "I think that's really impressive. And this is no, no violation at all. So you know, continue really, really impressive record with probation." 

The defense today also requested Moore be granted a third-party custodian who can watch him as he goes to certain places. 

Tolentino denied that request. 

"Still in line with the purposes of this release because I could’ve just said no conditions," the judge said. "But that’s not what the law requires of me, OK? I have to take into account the charges that are being made, OK? The safety of the community as well as to make sure we don’t have delays anymore of people not showing up. So the reasonable condition I came up with is the house arrest and the electronic monitoring and those accommodations. Now you come back with a motion to allow a third-party custodian whose obligations are going to be more stringent than the ones I have in place."

Moore is only allowed to leave his home to see his attorney, go to court, church, or the hospital.

When asked if Moore will take the stand in any of his upcoming trials, Phillips said, "There's no plan for that right now. Not anticipated.

Moore added, "I'm not against it."

He will now go to trial for the murder case next month before being retried in the drive-by shooting.
