Murder defendant Nicholas Wayne Moore is denied his request to get out prison. Moore stands accused in the killing of Michael Castro. Superior Court of Guam Judge Maria Cenzon issued her decision and order this week.

Moore was hoping to get out of prison ahead of his criminal trial for the murder case after spending the past seven months locked up.

Defense argued for his release primarily on the basis of ‘changed circumstances,’ including a recent mistrial in a separate drive-by shooting case, and the resignation of the assigned prosecutor in the murder case.

Prosecutors opposed his release alleging Moore violated a judge’s order when he was previously let out of prison.

Though Cenzon denied his release, the court did grant a defense request that would only require Moore to have one third-party custodian to watch over him, instead of the two TPCs previously ordered by the court.

Moore remains held on a $100,000 cash bail.

Court documents state a bail hearing would be set if Moore does post bail, adding he would be placed on electronic monitoring.

His murder trial is expected to begin in April.

Moore also faces separate charges of sexual assault charges in local court.
