Former mixed martial arts fighter Roman Alvarez wants his criminal case dismissed.  He appeared before Presiding Judge Alberto Lamorena Today in the Superior Court of Guam.  Alvarez was indicted on charges of attempted murder and aggravated assault in connection to a February 6 fight that occurred at a Tumon nightclub. 

The incident sent another man to the hospital after authorities say Alvarez allegedly hit the man with his car. Defense Attorney Jay Arriola argues the case should be dismissed, saying the alleged victim was the aggressor who jumped onto Alvarez's car. 

The defense motion contends castle doctrine law because Alvarez was inside his car at the time, and was only defending himself from being attacked. 

As we reported, a witness told police that the alleged victim put Alvarez in a headlock, punching his head before the pair left the club. 

The alleged victim was hit in the parking lot, as Alvarez was trying to leave. 

Parties will argue the case in court on January 19.
