Man accused of driving recklessly with open beer can refused alcohol test

Forty-six-year-old Eusebio Mendiola Manglona was arrested and charged with Driving with an Open Container of Alcohol as a misdemeanor and Reckless Driving as a petty misdemeanor.
According to court documents, on the evening of June 6, police got a report of a possible impaired driver. A witness said they saw a car, driven by Manglona, speeding toward a Mangilao intersection and then come to a screeching halt. The witness said Manglona turned onto the Route 10 middle lane driving a short distance. Manglona then got into a lane and came to a screeching halt again at the Route 10, 8 and 16 tri-intersection. He then sped down Route 8 nearly colliding with another car.
Police located Manglona in Toto where he was asked twice to roll his window down before complying. The officer noted the car smelled of alcohol and Manglona had bloodshot, watery eyes. A beer can with condensation was also located in the car's center console.
According to court documents, Manglona either did not understand the officer speaking to him or he ignored the questioning. However, he did deny having anything with alcohol. When told he was suspected of driving recklessly, he told officers he hadn't moved from where he was parked.
Officers eventually arrested Manglona after repeatedly trying to get his attention. While at the Central Precinct Command, Manglona refused to consent to test for the presence of alcohol.
