Guam - A Customs officer who filed a civil lawsuit against the agency for alleged violations of the American with Disabilities Act has agreed to throw out his case against Customs and not sue again.  Derrick Guerrero had sued his employer claiming the agency discriminated against him because of his disability after he underwent surgery. 

The parties filed a stipulation agreeing the suit would be dismissed without prejudice and there was no exchange of money.  The stipulation did not explain the reason for throwing out the suit.
