Seven GovGuam officials indicted in corruption investigations

Multiple Government of Guam officials - cabinet members, mayors, and other public sector representatives - have been indicted by a grand jury in the Superior Court of Guam in connection to two separate government corruption investigations.
The Attorney General’s Government Corruption Division alleged government funds were improperly used to pay Guam Regional Transit Authority interim executive manager Richard Ybanez for a position he was not qualified to hold. Prosecutors allege officials knew that Ybanez illegally held the top management position without the requisite college degree.
In January 2022, the board voted to approve Ybanez to the position in an acting capacity following the recommendation of Governor Lou leon guerrero. The Governor's Office confirming with KUAM Ybanez hasn't been serving in the position since before the storm.
ybanez was indicted along with GRTA certifying officer Jennifar Badar Cruz, GRTA board of directors chairman Alejo C. Sablan, board director and Hagat mayor Kevin J.T. Susuico, and board vice-chairman and Inalahan mayor Anthony Chargualaf.
The indictment includes charges of theft by deception conspiracy for misapplication of entrusted funds, misapplication of entrusted funds, and official misconduct, with a special allegations of crimes against the community.
Cruz was also indicted with tampering with public records. "No comment," said Mayor Susuico about the matter. "I don't think there was any basis, but we will see and let my attorney handle that."
"Let just provide my comments," said Mayor Chargualaf. "So the charges being alleged Richard Ybanez was placed as interim general executive manager and I am not sure how that was inclusive of us as the board when the appointing authority was the governor and then now we are being charged because he apparently did not have his credentials. Of course, that was done within the Governor's Office and they should be the one to be questioned on that. We are pretty much an advisory board and I am not sure what else to say. I haven't read it so I am limited with my comments."
The Governor's Office declined comment referring to the indictments "ongoing litigation".
A grand jury separately handed down an indictment Monday evening against Arthur U. San Agustin, the director of Public Health and Social Services, as well as DPHSS’ chief environmental health officer Tom Nadeau. San Agustin and Nadeau are each charged with obstructing governmental functions and official misconduct, along with special allegations of crime against the community.
The DPHSS director is also charged with five counts of tampering with public records. Prosecutors alleged sanitary permits for multiple Guam Department of Education schools were approved by responsible government officials without any inspections.
The schools named in court documents include Simon Sanchez High, George Washington High, and Southern High.
A summons was issued by the court for all defendants to appear before Judge John Terlaje on July 26.
