A man accused of sexually abusing a child multiple times is not fit to stand trial in the Superior Court of Guam. 31-year-old David Ben Cruz faced charges of first- and second-degree criminal sexual conduct.

The girl alleged Cruz sexually molested her repeatedly in 2019, adding that she was too afraid to tell anyone.

Cruz pleaded not guilty by reason of mental illness, disease, or defect.

Presiding Judge Alberto Lamorena this week signed the order ruling that the defendant is not competent to stand trial and accepted the plea.

His case is now before mental health court.
