No plea deal and case dismissed. Defendant Nicholas Wayne Moore was let off the hook at least for now in his drive-by shooting case.

A Superior Court Judge granted the defense's request for Mistrial. This allows the case to be dismissed without prejudice following multiple delays during the trial.

Moore was on trial for charges connected to a 2020 shooting in Agana Heights that sent another man to the hospital.

Defense attorney Mike Phillips told KUAM that prosecutors could refile the case stating, “It’s really up to the AG but hopefully there is a careful review of the testimony and AG agrees this is just not the case they thought it was. It was clear Mr. Moore didn’t fire a gun at all.”

There's no word yet if Moore could be released from prison just yet.

He still has two other criminal cases against him where he's charged with murder and criminal sexual conduct.
