Former State Historic Preservation Officer Lynda Aguon continues her appeal of her termination in a hearing at the Civil Service Commission held Thursday.


Trial dates were set by Administrative Law Judge Eric Miller, despite objections by Department of Parks and Rec counsel Donna Lawrence. Lawrence is an assistant Attorney general and she argued today that she would be off-island and that she as the only lawyer at the Office of the Attorney General familiar with Aguon's case.

Her points were roundly dismissed by the judge and merit hearing dates were set for three nights - Oct. 17, 22 and 29. All of the hearings will be held at 5:45 p.m.

Both sides will have to submit their list of witnesses and exhibits by Oct. 2. An evidentiary hearing will be conducted on Oct. 3 to see if more than three nights of trial will be needed.

Aguon was fired by DPR Director Rich Ybanez on June 18. Guam federation of teachers' field rep Robert Koss has said Aguon's final adverse action was full of "trifles" - with none of the alleged violations rising to the level of termination.
