Guam - Congresswoman Madeleine Bordallo is seeking greater clarification from the Department of Health and Human Services and the Centers for Medicare and Medicaid Services on TakeCare's recent actions.  TakeCare gave its shareholders $15 million, despite $11 million in unpaid claims and not paying a single penny in refunds mandated by the Affordable Care Act. 

TakeCare was able to avoid paying the rebates by being placed under a limited liability company, Veiovis.  By doing so, TakeCare was able to transfer its administrative costs to the new company.  In a statement issued today, Congresswoman Bordallo has asked HSS secretary Kathleen Sebelius to clarify the application of the medical loss ratio as well as the capitation provisions to this specific case on Guam.
