Feds seek dismissal of detainee's suit

Guam - The Federal Bureau of Prisons and the U.S. Marshals Service have asked that federal detainee Jason Daniel's lawsuit be dismissed. They allege that Daniels has failed to exhaust his administrative remedies and the Federal Tort Claims Act is the exclusive remedy for claims of monetary damages against the government.
But they note that federal agencies cannot be sued under that act. Additionally they argue that Daniels has no standing to enforce the terms of an intergovernmental agreement and fails to satisfy the requirements for alleging a class action suit. Department of Corrections also filed a motion to dismiss the lawsuit.
Daniels is seeking $50,000 in damages for the alleged substandard conditions in the Post 30 unit.
