Guam - The Government of Guam's motions to dismiss a class action lawsuit will be heard in the District Court next week. The government has filed a motion to dismiss a complaint filed by Jeffrey and Rea Paeste and Sharon Zapanta who were suing for tax refunds arguing the case is moot since refunds were paid out last month. The plaintiffs meanwhile have asked for the lawsuit to proceed and for the class to be certified.

They want the court to issue orders compelling the government to pay past year's refunds and ensure that future refunds are administered on time. They've also asked the court to determine that the expedited refund program be deemed unconstitutional and unfair.

The court has set a motions hearing for January 24.
