Supreme Court upholds dismissal of charges

Guam - The Guam Supreme Court upheld the lower court's dismissal of criminal charges against former governor Carl Gutierrez and former Government of Guam Retirement Fund Director John Rios. The appellate court directed the trial court to determine if the dismissal of the charges is with or without prejudice, which will determine if charges can be brought against the defendants again.
Rios and Gutierrez were accused of illegally enhancing the former governor's retirement benefits, but it was determined before trial that Gutierrez was entitled to them.
