Convicted rapist on parole arrested for terrorizing, stalking

A convicted rapist on parole ordered to stay away from certain people has failed to do so and now faces new terrorizing and stalking charges.


A magistrates complaint charges Alvin Gerald San Nicolas with:

 • Advanced Stalking as a second-degree felony
• Simple Stalking as a third-degree felony
• Two counts of Terrorizing as a third-degree felony
• Three counts of Violation of a Court Order as a misdemeanor
• Violation of a Court Order as a misdemeanor
• Three counts of Harassment as a petty misdemeanor


According to court documents on March 22, a victim met with officers to file a terrorizing complaint against San Nicolas, who allegedly threatened to kill the victim and their family. 

Further documents state, on another occasion, the defendant shared an image of a rifle/weapon to other victims. In other conversations, he described the victims' home, and sent photos of what appeared to be portions of their house, also detailing the surrounding areas of the residence.

San Nicolas admitted to having an altercation with the victim but denied any threats.

The complaint notes that the defendant was released from prison  August 2020, and placed on parole. As part of his release, the court ordered him to refrain from threatening to commit or committing acts of family violence, or from harassing or molesting the victim and victim's family.

San Nicolas was convicted on two counts of third degree criminal sexual conduct as a second degree felony in 2017.
