Inmate gets time-served sentence for prison contraband

An inmate at the Department of Corrections who faced up to 20 years in federal prison has been sentenced to time served.
John Trae Boy Duenas pleaded guilty last year to possession of contraband in prison after DOC's Special Operations Response Team found seven ounces of methamphetamine, cell phones, a digital scale, sim cards and other items hidden in his cell.
Federal prosecutors said Duenas cooperated significantly—including testifying against his cell mate and co-defendant, Richard Espedion. His defense attorney also pointed out he spent a year in solitary confinement as punishment.
Chief Judge Frances Tydingco-Gatewood ruled that Duenas had done “everything asked of him” and called solitary “one of the harshest punishments” a defendant could face. She gave him credit for time served and ordered three years of probation.
Duenas is already serving a nine-year sentence for criminal sexual conduct and is expected to be eligible for parole later this month.
