Public auditor says GACS was uncooperative with audit

Public Auditor BJ Cruz responded to criticism thrown his way at the Guahan Academy Charter School oversight hearing. GACS auditor Al Erguiza said the OPA audit of GACS for Fiscal Year 2017 was "biased."

Cruz meanwhile fired back, saying GACS refused to turn over documents, hired an attorney to fight turning over documents needed to conduct the audit. If the audit had been completed on time, it could have had an impact on the amount of money GACS was appropriated for FY 2019.


"This audit is 19 months late this should have been at the legislature when we were considering their budget last year," Cruz said. "In December we sent a note 'were going into calendar year '19 and there's still no audit documents hadn't been provided then it became people are dying staffers were getting sick we need some additional time. It was absolutely ludicrous."

Cruz told KUAM news GACS' secondary level - which lost its accreditation candidacy - should not be receiving GovGuam funds since it is in clear violation of Guam law.

"It's very clear in the charter - you don't have accreditation at the end of five years - it ends," he said.
