Honolulu appellate court hears plebiscite challenge

A Ninth Circuit Court panel in Honolulu has heard Guam's appeal of a local district court ruling on the proposed self-determination plebiscite. Special Assistant Attorney general Julian Aguon is challenging the decision by the Guam District Court. Chief judge Frances Tydingco Gatewood had ruled in favor of plaintiff Arnold Dave Davis that the native inhabitant-only vote was discriminatory and unconstitutional.

The hearing was held in a courtroom at the University of Hawaii early Thursday morning Guam time. A previously announced live-stream of the proceedings was not available.

We were also unable to reach lead counsel Aguon for comment, or Attorney General Elizabeth Barrett-Anderson, who her office confirms was also in Honolulu.
