DFS, Lotte Duty Free meet again in court

DFS and Lotte Duty Free squared off again Tuesday in superior court. This time over a DFS  complaint that Lotte intentionally interfered when it won a $150-Million dollar retail concession contract at the airport. Judge Arthur Barcinas has already ruled in favor of DFS, and voided the agreement. Now DFS contends that because it prevailed, it is entitled to use the same discovery in the interference case. Lotte counters that because it was not a party to the procurement lawsuit, any discovery from the case should not automatically be allowed in the interference case. Lotte argues that if DFS wants to use the documents and testimony it should go through the entire process. Lotte claims DFS plans to use the discovery to make new claims and add more parties to its interference complaint. It also called the motion unreasonable, and the DFS allegations "unfounded, inflammatory, and don't belong in this court."

The discovery in the procurement case remains sealed under a protective order. Meanwhile, the airport has appealed the Barcinas decision to the Supreme court.
