Acquittal motion denied in drug case

A major drug case against Raymond Martinez and Juanita Moser is back on. Defense now presenting its case - this coming after Chief Judge Frances Tydingco-Gatewood denied the defense's motion for acquittal, as well as the sealing of that judgment.

The couple is being charged with conspiracy and possession with intent to distribute methamphetamine hydrochloride. Among the reasons to acquit, Attorney Peter Perez pointed out the government's inability to prove both crimes beyond a reasonable doubt based on their witnesses.

However, Judge Gatewood found that there was enough evidence for a jury to reach a verdict. Ex-Customs Lieutenant Henry Alvendia was re-called to the witness stand by Moser's attorney, David Lujan. Once again trying to dismantle the witness's credibility.

Defendants argue they were entrapped by government agents with the help of Alvendia whenever they allegedly tried to smuggle 8 pounds of the drug, ICE, from Califonia to Guam. Trial continues Tuesday with the defense calling more witnesses to testify.
