Man convicted of sexually assaulting teen appealing case

Guam - A man convicted of sexually assaulting a 13-year-old girl is appealing his case with the Supreme Court of Guam.

Last year a superior court jury found Errol James Wusstig guilty of second degree criminal sexual conduct and child abuse.

Before Supreme Court justices Wednesday morning, his attorney Terrence Timblin argued that the alleged incident occurred in such close quarters, specifically a converted school bus where Wusstig and his son each had a bed.

The alleged victim reported the assault was inside the makeshift home, but as Timblin argues, Wusstig's son was always there and never saw the incident.

Because the victim reported the event two years later, no physical exams could occur.

The appeal was taken under advisement.
