Supreme Court issues opinion on medicinal marijuana issue

Guam - Next week marks the deadline for Attorney Howard Trapp to file his reply to the Guam Election Commission's response submitted earlier this week. As we reported, Trapp filed a petition for a writ of prohibition with the District Court of Guam asking for the legislative-submitted referendum on medicinal marijuana to be taken off the general election ballot. In GEC legal counsel Jeff Cook's response, he says Trapp lacks standing to come before the court for the writ of petition and therefore his petition should be dismissed. Trapp would not provide comment on the GEC's response until he submitted his reply to the court. However Trapp has been very public about his opposition to the referendum saying it is "inconsistent with the Organic Act." Trapp's response is due on October 14 and thereafter, Chief Judge Frances Tydingco-Gatewood will schedule a hearing if necessary.

In the meantime, the Supreme Court of Guam issued an opinion today adopting the principles and reasoning behind its initial decision back in Sugust in favor of the Guam Legislature's declaratory judgment regarding the measure.
