Overturned sexual conduct case set for 2nd trial delayed

Guam - Alvin San Nicolas was set to go to trial for a second time right before Christmas but the government is seeking a continuance.  San Nicolas pleaded not guilty to criminal charges handed down in a superceding indictment.

The Supreme Court of Guam recently overturned a conviction against San Nicolas on 16 counts of criminal sexual conduct for sexually assaulting a female minor repeatedly while her mother was deployed and forcing her to smoke methamphetamine.

Assistant Attorney General Matthew Heibel informed the court that they were seeking a delay because the victim is currently off island on a pre-planned family vacation.

The court set a hearing for December 20 to hear the motion.
