Accused murderer seeks release from jail

Guam - A man who is accused of murdering his mother is asking to be released to two third-party custodians. Allan Agababa appeared in the Superior Court of Guam today asking to be released from jail.  Because the court has not had time to review the probation's report on the proposed third-party custodians, the motion for release hearing and criminal trial setting was continued. 

The 26-year-old is being held behind bars on $1 million cash bail for the murder of his mother, Shelley Bernstein.  He is charged with aggravated murder. 

Bernstein was a flight attendant with United Airlines and lived with her two sons at her Tamuning apartment. She died from blunt force trauma to her head and an overdose of prescribed opiate.  Another hearing is scheduled for December 12.
