Guam - Superior Court Judge Arthur Barcinas will not be presiding over Police Captain Mark Charfauros' criminal case. During a hearing this morning, the Attorney General's Office filed a motion to disqualify the judge. Barcinas attempted to remove himself from the case as he disclosed that he is friends with Charfauros, but Acting Presiding Judge Elizabeth Barrett Anderson found the reason to be insufficient for recusal.

With the prosecution's concerns, the judge removed himself and the case will be reassigned to another judge. Charfauros meanwhile has asserted his right to a speedy trial and denies that he solicited another officer to commit assault.

He remains on administrative leave with pay from the force.
