GEC board debates on judge presiding over case

Guam - There's debate over whether Superior Court Judge Arthur Barcinas should preside over the 2010 election challenge that was filed by former governor Carl Gutierrez, who lost in the last gubernatorial election. The parties were in court last week and Barcinas indicated that he sits on the Juvenile Justice Commission with Governor Eddie Calvo. 

The parties must present any objections to Barcinas sitting on the case by Tuesday. Chris Carillo was the only GEC board member who opposed the judge remaining on the case. Carillo argued the judge was appointed during a Republican administration and has ruled against Gutierrez in the past and should not be allowed to sit on the case. GEC attorney Jeff Moots said his concerns were valid but are normally not grounds for recusal. 

They will be taken under consideration and the attorneys will present their thoughts during a hearing this Tuesday.
