Guam - The 9th Circuit Court of Appeals has affirmed the District Court of Guam's award of $7.5 million to a U.S. Air Force couple who filed a medical malpractice claim on Guam in 2008. Deborah and Thomas Rutledge filed suit after she sustained severe injuries and neurological injury because Air Force medical personnel did not meet the applicable standard of care.
The federal government appealed the district court's findings and claimed that the court erred in awarding damages. The appellate court however found that "the award was not so excessive as to shock the sense of justice under Guam law".
