Phillips to seek dismissal of pending challenges

by Nick Delgado

Guam - With one election challenge down and two to go, Attorney Mike Phillips, the legal counsel for Governor-elect Eddie Calvo and Lieutenant Governor-elect Ray Tenorio, doesn't think Saturday's Supreme Court decision will impact the pending case in the Superior Court. Justices issued their decision denying Carl Gutierrez and Frank Aguon Jr.'s writ of mandamus request for the decertification of the Decision 2010 General Election results.

"I don't think it has too much of an affect directly," he told KUAM News. "Obviously it sets a trend, but that cases were very different and upstairs the petitioners - Governor Gutierrez and Senator Aguon were very careful not to allege any wrongdoing; downstairs they are alleging wrongdoing."

Phillips says hi intends to file several motions to dismiss the pending election challenges and says they are prepared to go through the trial and he remains confident they will prevail.
