Dismissal motions to be heard in Adkins case

Guam - District Court Magistrate Judge Joaquin Manibusan is scheduled to hear several motions to dismiss tomorrow in local businessman James Adkins' civil suit.  Adkins is suing Police Chief Paul Suba and Guam Police Department officers D.B. Anciano and Serafino Artui, who are all moving to dismiss the case.

Adkins argues that he was illegally arrested, detained and incarcerated after he took photos of a car crash using his cell phone.  The local businessman has retrieved his cell phone but is now asking the court to allow a special retrieval process on his phone as he says the photos he took of the crash have "mysteriously disappeared."  Adkins believes the phone was tampered with while in police custody.

The hearing on the motions to dismiss is scheduled for Tuesday morning at 10 in the federal court.
