Fernsler maintains termination appeal

Former D.L. Perez Elementary School teacher Fredrick Fernsler is no longer employed with the Department of Education, but he continues to appeal his termination with the Civil Service Commission.  DOE Legal Counsel Fred Nishihara says the agency has already completed its own investigation, but is now waiting on the criminal case and the CSC to be resolved.

He told KUAM News, "The superintendent wants to ensure that the students attending the public schools are safe. So if it means taking our time and making sure investigations are complete, that's what we'll do. If it means going through the appeals with the civil service, then that's what we'll continue to do."

The parties are discussing a possible settlement in relation to the case before the CSC.  Another status conference is scheduled for December 1. 

In the meantime, Fernsler is scheduled to appear back in court on November 17, while jury selection and trial is slated to begin on December 9.
