Motion to dismiss filed in gambling lawsuit

The Attorney General's effort to rid the island of gambling machines that have been paying out cash continues in the Superior Court this afternoon. But the attorney for the director and deputy director of the Department of Revenue and Taxation filed a motion to dismiss the lawsuit.

This afternoon the parties will appear before Superior Court Pro-tem Judge Robert Klitzkie who is scheduled to hear the AG's pre-emptory writ request. As we reported the AG is seeking a court order to force Rev and Tax to revoke more than 900 gaming licenses and also order the confiscation and destruction of the gambling machines.

Last month the judge denied the AG's writ of mandate and also dismissed Lt. Governor Mike Cruz from the case. The hearing begins at 2 o'clock.
