Not only will notices of revocation not be handed out, but according to Revenue and Taxation Director Art Ilagan the appeals hearing scheduled for August 1 before the General License Board for D&D Games and Guam Music Inc. has been cancelled because there's no adverse action for them to appeal.This all goes back to the Acting Governor's Directive issued on the day the licenses were to expire, ordering Rev and Tax to renew the licenses because of alleged due process rights violations. As we reported the owners of amusement devices on May 29 were given letters notifying them that their licenses would not be renewed because an investigation by the AG's office and an Anti-Gambling Task Force-- determined the machines were illegal gambling devices. These same owners were also given 15 days to file an appeal to Rev and Tax. While they did, because of the Acting Governor's intervention, all their licenses were renewed, which Rev and Tax contends makes their appeals a moot issue.The entire situation has now ended up in court, as the AG is suing the Acting Governor along with Rev and Tax. No hearing, however, has been scheduled to date.
