AG's Office files order with District Court

The Office of the Attorney General, on behalf of the Government of Guam, has filed a proposed order with the District Court of Guam. Chief Judge Frances Tydingco-Gatewood continues to deliberate on the issues of federal receivership of the Ordot Dump and the report and recommendations issued earlier this year by District Court Magistrate Judge Joaquin Manibusan. According to the proposed order submitted by the AG's Office they are recommending the judge order the Government of Guam to move forward with constructing the new landfill in Layon or Dandan as several studies have already been done to determine its suitability.

It also noted that the Dandan site has already been approved by the U.S. Environmental Protection Agency. The proposed order also states that the court does not oppose consideration of other solid waste options for GovGuam. In terms of federal receivership, the government's position is clear in the court document as it stands firmly against it.

Meanwhile, the AG's Office clarifies that its proposed order only reflects the public sector's position, not that of the 29th Guam Legislature. In part, it states, "There are no doubt differences of opinion among the individual members of the Legislature on various issues covered in the proposed order. And the will of the legislative body as a whole is unknown and cannot be determined."
