Initial Prop "A" paperwork with justices

Opening briefs today were filed with the Guam Supreme Court today as the Guam Election Commission hopes to get clarification on a Superior Court judge's decision in the Prop "A" case. Prior to the Decision 2006 General Election last November, Superior Court Judge Arthur Barcinas ruled that Prop "A" was to be taken off the ballot and the results not certified.

Prop "A" proponents, including the Coalition 21 organization, fought to have the issue placed on the ballot. GEC legal counsel Attorney Cesar Cabot argues the Commission followed the election code when dealing with the initiative and the Guam Administrative Rules are outdated. Opening briefs were filed in the appeal today, with Supreme Court justices to hear the matter in a few weeks.
