Decision made in Tenorio's child support case

A Superior Court judge found that an agreement for child support between Senator Ray Tenorio (R) and his ex-wife, Evangeline Marcus, violates the rights of their five minor children. Several months ago Marcus submitted a motion to modify child support, saying a $35,000 lump sum agreement was insufficient to support the children. Tenorio however argued the contract was binding and the amount he provided several years ago was adequate.

Superior Court Judge Michael Bordallo however found portions of the agreement to be invalid, saying any waivers violated the rights of the children. The judge added that parents cannot waive the rights of their children as it is unacceptable, against public policy and prohibited by the Judiciary.

The parties are now expected to submit updated calculations for child support by the end of the month.
