Senator Tina Rose Muna-Barnes (D) has introduced Bill 395, The Ordot Liability Recovery Act of 2008. The legislation seeks to recovery liabilities from the federal government for their years as founders and operators of the Ordot Dump. The measure would assign $200,000 to the Attorney General's Office to hire a special counsel to pursue legal remedies to the U.S. Environmental Protection Agency's enforcement action against the Government of Guam.
The senator stated, "Thus far, the federal enforcement actions brought by the USEPA has not included action against the U.S. military or the federal government for their roles in creation of one of this nation's worst toxic waste sites. This would leave Guam solely and disproportionately responsible for the enormous costs to comply with court orders to close the dump. That is simply unacceptable."
